We spoke with Eraldo D’Atri and Jemima Roe of Clifford Chance about their pro bono case on behalf of Christie Elan-Cane. The case centres around the UK government’s refusal to issue non-gendered (X) passports. In pursuing this case, Clifford Chance are hoping to take vital step in the battle for equal rights for the trans community, intersex people and those who identify as non-gendered. While the case was initially dismissed, the UK Courts have recognised that the European Convention on Human Rights (Article 8) guarantees a right to respect for non-gendered identity for the first time. A decision is expected on the appeal on Tuesday, 10th March 2020.
